It is totally rediculous that the Content by Query Web Part is not available under WSS. I've designed several solutions in MOSS, and have grown to like that Web Part. But evidently, it is used by the Publishing Assemblies only available in MOSS. The question I would ask is why make it a Web Part if it doesn't follow the Web Part design infrastructure capability of ASP.NET 2.0. They spent all that time re-writing Web Parts for MOSS, but we can't use all of them. THUMBS DOWN TO MICROSOFT for this one! Yes, I agree.

It is totally rediculous that the Content by Query Web Part is not available under WSS. I’ve designed several solutions in MOSS, and have grown to like that Web Part.
